
The case, filed in a Californian court, seeks a bar on further publication and the return of the pictures. Hilton has argued though that the picture is just as available for viewing on other websites and that because Hilton published the picture "for the purpose of commentary and satire," his actions constitute fair use.
The studio wants an injunction on future use of the picture and a court order "directing the US Marshal to seize" the copyrighted material.

Perez has a great point. You can get these pics anywhere on the internet, on PLENTY of celebrity forums out there. They are everywhere. Yet they are only coming after the bloggers..?
